PLANNING APPLICATION RE-SUBMISSION (NEW REFERENCE 12/03464/OUT)

9 September 2014 The Secretary of State, having correctly this time 'called in' the Inspector's decision to allow White Lion Land's appeal against Wiltshire Council's refusal for 77 houses in Park Road, has overturned the Inspector's decision. This is excellent news in respect of our Neighbourhood Plan.  A brief summary of the Minister's decision is reproduced below … (original here)

Overall Conclusions
21. The Secretary of State has had regard, on the one hand, to the fact that the Council cannot at this stage demonstrate a 5 year housing land supply, so that the terms of the Framework require that planning permission should be granted unless any adverse impacts would significantly and demonstrably outweigh the benefit; and on the other hand to the opportunity which the neighbourhood plan process gives local people to ensure they get the right types of development for their community while also planning positively to support strategic development needs. He regards these factors as being finely balanced in this case and, having regard to the particular context of this appeal (referred to in paragraphs 16-18 above), he concludes that the immediate benefits of releasing the appeal site as a contribution to meeting overall housing demand in the wider area are insufficient to justify the release of this site so soon before the examination of the NP proposals is complete and there has been an opportunity to test them by means of the referendum.

Formal Decision
22. Accordingly, for the reasons given above, the Secretary of State disagrees with the Inspector’s recommendations. He hereby dismisses your clients’ appeal and refuses planning permission for a residential development (77 dwellings), a community building, public open space, and associated works including construction of a new access, in accordance with application Ref N/12/03464/OUT, dated 18 June 2013.

4th August 2014. Date scheduled for Planning Inspectorate to issue decision on appeal by White Lion Land.

1st April 2014. Planning Inspectorate hearing into appeal by White Lion Land commences.

18th June 2013. The application was REFUSED. Reasons for the refusal can be seen here. Reasons include: the application lying outside the Framework Boundary of the North Wilts Local Plan 2011; prematurity; and lack of provision of affordable housing. 

18th October 2012. White Lion Land have re-submitted their original planning application for 77 houses, under a new reference: 12/03464/OUT. This is treated as a new planning application.

15th March 2012. The Appeal was REFUSED. 

24th October 2011, White Lion Land Appeal - Association Comment to Planning Inspector
The Association has commented (see attachment below dated 24-10-11) to the Planning Inspectorate on White Lion Land's appeal against Wiltshire Council's refusal of planning permission for 77 houses off Park Road.  Our comment below includes guidance on making your own comment by 2nd November.
 
18th October 2011. Meeting about the town's response to White Lion Land's appeal - 18th October, Town Hall.  White Lion Land has appealed (see attachment) against Wiltshire Council's refusal of planning permission (see attachment) for 77 houses off Park Road. The appeal deadline is 2nd November. There will be an extended meeting of the Town Council Planning Committee in the Town Hall on 18th October to allow discussion of the town's response.
 
11th August 2011: The application by White Lion Land to build 77 houses off Park Road has been refused by Wiltshire Council (although the developer still has the right of appeal). Our Chairman said "The Association Committee, its members and all those residents in the town who wrote and opposed the application can be rightly proud of their efforts. This is a shining example of what can be achieved when people come together with a common purpose and are open and honest in their dealings with each other." Wiltshire Council's letter to the developer is attached.
 
 
Wiltshire Council have received an application for Outline Planning Consent from White Lion Land for the construction of 77 new houses, a community building and public open space on land off Park Road, Malmesbury.
